Introduction
This guide was developed to assist you through the residential permit requirements in the City of Stow. We hope the information will simplify and expedite the process of obtaining a permit, scheduling inspections for your project.
Specific or technical questions should be directed to the appropriate City Department or referenced through the Building Code or City Ordinances.
Codes and ordinances are adopted to provide minimum standards for the protection of life, limb, health, property, environment, and for the safety and welfare of the consumer, general public and occupants of residential dwellings. Enforcement of these codes is essential for maintaining attractive and safe housing for all Stow residents.

CHAPTER 1
RESIDENTIAL PERMIT INFORMATION

WHAT IS A PERMIT?
A permit is a license granting legal permission to construct, enlarge, alter, repair, or demolish a dwelling or a structure, or install, alter or repair mechanical, electrical, or plumbing systems within a dwelling or structure.

Your project may require one or more of these permit types depending on the scope of the work to be performed. Applications may be picked up at the Building Department or online.

Advantages to obtaining a permit for construction include:
·Each phase of construction is inspected and approved for compliance with the code.

·If there is a violation, the inspector can advise on how to correct the problem.

There may be legal and financial liabilities to the homeowner when work is performed without a permit.
Our codified ordinances specify that a permit must be issued when any of the following is to be performed:

  • Residential Structures
  • New one, two and three family dwellings
  • Additions to one, two and three family dwellings
  • Accessory buildings and additions thereto
  • Alteration and restoration of residential structures
  • Electrical installation
  • Mechanical installation (HVAC)
  • Decks, porches and enclosures
  • Roofing
  • Siding
  • Fences
  • Right-of-way (site work)
  • Demolition
  • Swimming pools
  • Structural retaining walls
  • Major repairs or installations

When applying for a permit, construction drawings may be required. The review period depends upon the type of permit being applied for.

Who Obtains a Permit?
The property owner/occupant may take out a permit. Otherwise, a registered general contractor or subcontractor in the electrical or mechanical trades must obtain the permit. The permit holder is legally responsible for the work for which the permit was approved and issued.

Permit Fees:
Permit fees for residential projects vary from fixed rate fees to fees based on estimated value or square footage. If work is started prior to obtaining a permit, the penalty is the original permit fee plus an additional 300%. To determine your fees, click on permit fees. A 1% permit fee surcharge is required by the State of Ohio for all residential permits.  

Right-of-Way Bond:
In addition to a permit fee, a bond may be required for work within the City right-of-way. After the work has been inspected and approved, this bond is refundable upon request.

Street Trees:
A street tree deposit may be required for new residential construction. The City Arborist reviews the Site Plan and approves street tree plantings on curbed streets. A tree planting form is filled out by the Arborist and returned to the Building Department for processing with the building permit application. A fee will be charged per tree to be planted on the tree lawn. (The tree lawn is the grass area between the sidewalk and the street). The tree fee is based upon the length of street frontage.

Expiration of Permits:
Construction must commence within six months of issuing a permit. A permit will become void if progress, as determined by the inspection record, is suspended for a period of six months or more. To renew an expired permit, contact the Building Department.

Contractor Registration Requirements:
Contractors must be registered with the City of Stow by completing a registration application, which may be picked up at the Building Department or online.
Electrical and mechanical contractors must also submit a current State of Ohio Certificate of Qualification issued by the Ohio Construction Industry Examining Board.

Residential Energy Conservation Requirements:
The Ohio Board of Building Standards has adopted energy conservation standards for detached one, two, and three family dwellings in Ohio. These requirements may be found in the Residential Code of Ohio. 
In order to establish compliance and enforcement the Building Department requires energy conservation compliance data for residential projects when plans are submitted. If you are not familiar with this requirement, consult with your H.V.A.C. or insulation contractor. Free energy conservation software is available at www.energycodes.gov

Ohio Codes and Standards:

Plan Review:
Documents submitted for permits are distributed to various city departments for review. The plan review period generally takes 3-5 working days. If additional information is required, you will be contacted. You can check the status of your application by calling the Building Department.

When is a Permit NOT required?
Generally, permits are not required for routine maintenance of existing structures or dwellings. Some examples are:

  • Replacing lumber on a porch or deck
  • Replacing windows
  • Painting

House Numbers:
Engineering Department issues house numbers for all new one, two and three family dwellings.

Water and Sewer Permits:
Sanitary Sewer permits must be obtained from Summit County Department of Environmental Services (2525 State Road, Cuyahoga Falls, Ohio 44223 or call at (330) 926-2409) prior to issuing the Water Permit.
Water permits are issued through the City of Stow Engineering Department and generally take 3-5 days for review and approval. Water permits, current fees and specifications can be obtained at the City of Stow Engineering Department, Monday through Friday between 8:00 a.m. to 4:30 p.m., (excluding 12:00 p.m. to 1:00 p.m.) or call at (330) 689-2719.

A Sanitary Sewer permit and Water / Well permit are required for the issuance a New Home Building Permit.

Plumbing Permits:
Plumbing permits are issued by the County of Summit Building Inspection Department located at 1030 E. Tallmadge Ave., Akron, Ohio 44310. For questions call (330) 630-7280 ext. 4.

Well Permits:
Well Permits are issued by the Summit County Environmental Health Department located at 1100 Graham Road Circle, Cuyahoga Falls, Ohio, 44223, and (330) 923-4891. If you are unable to obtain a well permit prior to construction, an affidavit will be required by the Building Department.

CHAPTER 2 
ZONING REQUIREMENTS

ZONING REGULATIONS

The City of Stow Zoning code divides the City into specific "districts" or "zones" depending on use. For example, a single-family residential district, (R-1, R-2, R-3) signifies that only single-family homes are permitted to be constructed in the district without the approval of the Planning Commission and Council. Other uses may be permitted with Planning & Council’s approval.  When applying for a building permit, the application is reviewed by the Zoning division of the Planning Department. The site plan and structure location must comply with the requirements of the zoning district in which you are building. 

ZONING RESTRICTIONS          

The Zoning code is intended to maintain the design and character of a neighborhood. The code regulates the density of development, lot size and width and the location and height of buildings.  The code requires specified minimum distances between buildings and property lines. This distance is known as the building setback.  The setback is measured to the furthest most point in the building footprint including but not limited to cantilevers for bay windows, fireplaces etc. Please note that roof overhangs, chimneys, architectural features, awnings and canopies may encroach into the required setback a maximum of twelve inches.  

The setback maintains the character of the neighborhood while also insuring that the structure is accessible. Properties may have utility easements and public right-of-ways, which could affect building location and other construction issues.

When planning a project, property owners should check deed restrictions and subdivision covenants. The City of Stow does not review, check, or enforce these types of requirements.

NOTE: Two family, multi-family and certain uses in Residential Business districts require City Planning Commission and City Council approval before a Zoning Permit may be issued. 

VARIANCES TO THE ZONING CODE

The Building and Zoning Appeals Board is a group of Stow citizens appointed by the Mayor to review variance requests to the City zoning and building codes. If a minimum setback or other code requirement cannot be met due to a special hardship, an appeal for a variance may be made to this Board. An Appeals Board filing procedure packet may be picked up across from the main Receptionist or from the Zoning Department, both on the first floor of City Hall.

Questions regarding the zoning code, zoning districts, permitted property uses, building setbacks, etc., should be directed to the Zoning Office located in the first floor of City Hall at (330) 689-2701. Zoning office hours are Monday through Friday 8:00 a.m. to 4:30 p.m.  The office is closed from 12:00 p.m. to 1:00 p.m.

CHAPTER 3
BUILDING REQUIREMENTS

Building Code:
The City of Stow enforces the Residential Code of Ohio for residential construction. A copy of the code is available for reference at the Building Department counter for review.  

Mechanical Code:
The City of Stow enforces the mechanical chapters of the Residential Code of Ohio for heating, ventilation, and air conditioning installations. A copy of the code is available at the Building Department Counter for review.

Fuel Gas Pressure Test Requirement:
When fuel gas piping is installed for new construction or remodeling projects, the City of Stow Building Department House Fuel Gas Line Pressure Test Form shall be completed and returned to the Building Department prior to issuance of a Certificate of Occupancy.  Fuel gas piping and tests shall be conducted in accordance the International Code Council Fuel Gas Code. Please contact the Building Department if you have any questions regarding this rule.

Electrical Code:
The City of Stow enforces the National Electrical Code (NFPA 70) governs the wiring of residential structures. The Building Department has copies of this code available for review.  

Right-of-Way Requirements:
The Engineering Department has established general site improvement criteria and construction standards for new and existing properties. A Right-of-way permit is issued for construction within the public right-of-way and within certain easements dedicated for public use. This permit covers such installations as city sidewalks, driveway approaches, storm sewer connections, water and gas lines, etc.

CHAPTER 4
ENGINEERING REQUIREMENTS

SITE PLAN FOR NEW ONE, TWO, AND THREE FAMILY DWELLINGS
4 Copies of a topographic survey and site plan are required when submitting for new one, two and three family dwellings. All site plans to be reviewed by the City shall include the following information:


A. GENERAL INFORMATION

 

  • The scale of the site plan not less than 1-20 scale;

 

  • Include the lot number, subdivision, builder and property owner; and

 

  • Indicate lot dimensions including bearings and distances and also indicate true ↑North with an arrow.

B. LOT DIMENSION INFORMATION

 

  • Distances of front, rear, and side yard;

 

  • Building setback of all buildings existing and to be constructed on the lot;

 

  • Location and dimension of all proposed and existing structures on the lot including porches, decks, fireplaces, etc.;

 

  • Flow arrows indicating proposed site drainage pattern and swales;

 

  • Show the location of city walks, driveways and approach, steps and building walks, retaining walls, fences, etc.;

 

  • Show the location and size of sanitary and water service connections;

 

  • Indicate storm water and sump drainage system;

 

  • Show erosion control measures, if needed; and

 

  •  Show location and elevation of the benchmark used for the site.

 

C. ELEVATION INFORMATION

Elevation information shall be submitted in U. S. G. S. format. Benchmark information may be obtained from the Engineering Department, or from the Summit County Department of Environmental Services (D. O. E. S.). (Show existing elevations over proposed.) Required site elevation information should include:

 

  • The first floor of the dwelling, garage finished floor, basement finished floor, and bottom of the footer on all buildings;

 

  • Finish curb or crown of the street at a point of extension of the lot lines;

 

  • Existing and proposed grade elevations at each principle corner of all proposed and existing structures on the lot;

 

  • Existing and proposed grade elevations at each principle corner of all proposed and existing structures on the lot;

 

  • Existing and proposed grade elevations at each principle corner of all proposed and existing structures on the lot;

 

  • Finished grade at the back of the city walk;

 

  • Finished ground and first floor elevations of buildings on adjacent lots; and

 

  • Elevations and topographic for all areas within 25 ft. of lots which are on the same side of the street.

 

Note: The garage floor elevation shall be a minimum of +1.5 ft. above the top of the curb, in line with the center of the garage doorway. The maximum recommended drive slope is +10%.

 

D. GENERAL GRADING REQUIREMENT

The slope away from buildings shall fall a minimum of 6 inches within the first 10 ft., except as restricted by the property line where the fall shall be 6 inches regardless of the horizontal distance.
All new single family dwellings are required to have a sump crock installed on the lowest floor level. This requirement may only be waived by the City Engineer.

CHAPTER 5
CONSTRUCTION DOCUMENTS


Required Documents. Residential construction documents and other data shall be submitted in two or more sets with each permit application for an approval. Before beginning the construction of any residential building for which construction documents are required, the owner or their representative shall submit construction documents to the Stow Building Department for approval. When construction documents have been found to be in compliance with the rules of the Ohio Board of Building Standards, that compliance shall be deemed sufficient to obtain approval for construction to proceed and the residential building official shall issue the permit. .
Residential construction documents shall be dimensioned and drawn upon suitable material. Electronic media documents are permitted to be submitted when approved by the residential building official. Construction documents shall be coordinated and of sufficient clarity to indicate the location, nature and extent of the work proposed and show in detail that it will conform to the provisions of the code. Construction drawings shall include information necessary to determine compliance with the building, plumbing, and fire protection codes. (See Chapter 7)
Construction documents drawn to scale (1/8" or 1/4" per foot) are required for new residential building construction, as well as additions or structural alterations to existing residential buildings and site improvements to new or existing lots.

Site plan: A site plan showing to scale the size and location of new residential construction and all existing structures on the site, including setback and side yard dimensions, all property and interior lot lines, distances from lot lines, the locations of the nearest streets. In the case of demolition, the site plan shall show construction to be demolished and the location and size of existing structures and construction that are to remain on the site or plot. The residential building official is authorized to waive or modify the requirement for a site plan when the application for approval is for alteration or repair or when otherwise warranted.

Residential buildings or structures located in flood hazard areas. Construction documents submitted for residential buildings or structures located in communities with identified flood hazard areas shall include the current FEMA Flood Hazard Boundary Map (FHBM), Flood Insurance Rate Map (FIRM) or Flood Boundary Floodway Map (FBFM) for the project location. The required site plan shall include building elevations using the same datum as the related flood hazard map. The owner shall be responsible for the compliance with local flood damage prevention regulations for additional critical elevation information for the project site.

The drawing must be drawn to scale showing all existing and proposed structures and building dimensions, property lines and the distance between the property lines and the addition area on all sides. Also include distances between any existing or proposed structures.

Foundation Plan:
A foundation plan shall show the dimension of the proposed foundation, including footers, pilasters, beam locations, beam sizes and spans, foundation wall dimensions, sump location, post size and spacing, etc.

Floor Plan:
A floor plan shall show architectural and structural features of your home, including all room dimensions and designations, window sizes, stairways, attic access openings, attached garage, smoke detector and exhaust fan locations, partial basements and full or partial attics. Wall materials shall be described by cross-hatching (with explanatory key), by notation, or by other clearly understandable method. Spaces must be identified by how each space is intended to be used;

A section drawing is a slice through the structure showing the building section from footer to the roof covering and all components in between. Cross sections, wall sections, details include typical connections as required to fully describe the residential building construction showing wall, ceiling, floor and roof materials. Cross sections details shall also include exterior envelope energy conservation information in sufficient detail to determine compliance with this code.

Also, a complete structural description of the residential building including size and location of all structural elements used in the design of the residential building and other data as necessary to fully describe the structural system is required.

If you are building a multi-family dwelling provide the fire-resistance ratings of all structural elements as required by the code, data substantiating all required fire-resistance ratings including details showing how penetrations will be made for electrical, mechanical, plumbing, and communication conduits, pipes, and systems, and the materials and methods for maintaining the required structural integrity, fire-resistance rating, and fire-stopping.

Exterior Elevations:

The residential construction documents shall provide details of the exterior wall envelope as required, including flashing, intersections with dissimilar materials, corners, end details, control joints, intersections at roof, eaves, or parapets, means of drainage, water-resistive membrane, all elevations necessary to completely describe the exterior of the residential building including floor to floor dimensions, and details around openings.
The exterior elevation is a picture view of the proposed project from all sides showing what the structure will look like when complete. Architectural features should include:

  • Position and height of windows and doors
  • Proposed roof slope and overhang dimension
  • Type of exterior finish materials
  • General grade around the structure

CHAPTER 6
INSPECTIONS

Building Inspections:
Inspections are intended to protect the homeowner against shoddy work, faulty materials, deviations from the approved plans and violations of code that could result in unsafe or hazardous conditions. A re-inspection fee may apply if the same violation occurs on more than two subsequent inspections.
Inspections may be scheduled by calling the Building Department at (330) 689-2729 or the 24-hour voice mail at (330) 689-2728. A 24-hour notice is required for all inspections. When requesting an inspection, please provide the following information:

  • Permit Number
  • Address
  • Owner's Name
  • Contractor Name
  • Type of Inspection

Building inspections should follow the sequence of construction. Mechanical and Electrical inspections must be approved prior to the framing inspection. All dwelling units must pass final inspection before occupancy will be issued. The following is the general sequence in which inspections should occur:

Engineering Inspections:
These are scheduled by calling the Engineering Office at (330) 689-2719. A 24-hour notice is required for all inspections. Engineering inspections are required for the following:

  • Driveway Approach;
  • City Sidewalk;
  • Storm Sewer Tie-ins; and
  • Final Grading.

Engineering Grading Final and Bond Release Requirements:

  • Foundation backfilled and fine graded.
  • Downspout connections completed, inspected, backfilled, and graded.
  • Sidewalks and approach completed including backfill and fine grading.
  • Tree lawn or ditch line fine graded.
  • Culverts installed, no bent or crushed ends allowed.
  • Yard drains, if required, completely installed, and tie-in inspected, backfilled and fine graded.
  • Swales established, where required.
  • Final Engineering grading approval.
  • No spoil piles or trash left in yard.
  • House numbers installed on house.
  • Property pins in place.

Zoning Inspections:
These are required for all new construction where a zoning certificate was issued; including the following:

  • All new structures
  • Fences
  • Accessory buildings (including gazebos)
  • Swimming pools
  • Additions to existing structures

CHAPTER 7
PLAN REQUIREMENTS FOR CONSTRUCTION PROJECTS

New Construction, One, Two and Three Family Dwellings:
Building Permit Application obtained from the Building Department or online.

2 Sets of construction drawings including: Index (located on first page of plans), Foundation Plan, Floor Plan, Exterior Elevations and Wall envelope, Cross Sections, Structural Details, Ratings (if applicable) and the following;

Building Systems: Description of the mechanical, plumbing and electrical systems, including: materials; location and type of fixtures and equipment; materials, and sizes of all ductwork; location and type of heating, ventilation, air conditioning and other mechanical equipment; and all lighting and power equipment;

Additional information: Additional graphic or text information as may be reasonably required by the residential building official to allow the review of special or extraordinary construction methods or equipment.
Fire Protection System Drawings: (if applicable) Construction documents for the fire protection system(s) shall be submitted to indicate conformance with this code and shall be approved prior to the start of system installation.

Manufacturers Installation Instructions: Manufacturers installation instructions, as required by this code, shall be available on the job site at the time of inspection.

Amended construction documents: If substantive changes to the residential building are contemplated after first document submission, or during construction, those changes must be submitted to the residential building official for review and approval prior to those changes being executed. The residential building official may waive this requirement in the instance of an emergency repair, or similar instance.

NOTE: Applications will be reviewed by Engineering, Zoning, Landscaping and the Building Department. Permit applications take approximately 3-5 days to process from the time the information is received. The water permit may be applied for when applying for a building permit. All Contractors must be registered with the City of Stow.
Additions, Accessory Buildings, Porches and Decks:
You must submit:


Building Plans: 2 sets of each that should include the following:
  • Foundation Plan
  • Floor Plan
  • Cross Section
  • Exterior Elevations
  • M.E.C. Calculations, if applicable

Site Plans: 4 sets for an addition.

 

The plan review process takes approximately 3 - 5 days.

NOTE: A permanent foundation is required for storage sheds over 150 square feet. Storage sheds up to and including 150 square feet may be installed without a permanent foundation. A building permit fee is required for accessory buildings at or in excess of 50 square feet.
Alterations & Conversions:
You must submit:


Building Plans: 2 sets of each that should include the following:
  • Foundation Plan, if applicable.
  • Floor Plan.
  • Cross Section.
  • Exterior Elevations, if applicable.
  • M.E.C. Calculations, if applicable.

Site Plan: 4 sets, if the building footprint is altered.

Siding and Roofing:
Siding and roofing permits are issued over the counter. Plans are not required for these types of permits.
Demolition:
Demolition permits for residential buildings and structures are issued over the counter providing that the structure has never been used commercially. If the structure has been used commercially at any one time, application must be made with the EPA and approval must be granted for demolition before a permit for Razing (Demolition) can be issued.

Plan Submittal Requirements - 1, 2 & 3 Family Dwellings
Plan submittal requirements for One, Two and Three family dwellings have changed with the implementation of the new statewide residential building code. In addition to the general plan requirements outlined in the Guide to Residential Permits (Ch. 7), you are now required to provide a description of the mechanical, plumbing and electrical systems (Note: Plumbing permits are issued at the Summit County Building Department ph. (330) 630-7280).
The description shall include: materials; location and type of fixtures and equipment; materials and size of ductwork; location and type of heating, ventilation, air conditioning and other mechanical equipment; and all lighting and power equipment. Additional graphic or text information may be required by the building department to allow review of special or extraordinary construction methods or equipment.
The following forms and examples are provided to assist you in detailing and describing your project mechanical systems for plan review and permits. These forms are not the only acceptable method of meeting the above rule and are offered as a guide for your use.
